Please read these Terms of Service ("Terms") carefully before using soleplaybama.com (the "Site"). The Site and the Sole Play retail location are operated by Favorite-Hi-Fashions, Inc., a corporation organized under the laws of the State of Alabama, doing business as Sole Play ("Sole Play," "we," "us," "our," or "Company").
By accessing or using this Site, placing an order, or creating an account, you agree to be bound by these Terms.
1. Eligibility
You must be at least 18 years of age to use this Site. We reserve the right to refuse service to anyone, at our sole discretion, with or without notice.
2. Products, Pricing, and Availability
We make every effort to display products accurately. All prices are in U.S. dollars and subject to change without notice. Sole Play does not guarantee, confirm, or publicly disclose stock levels, future restock plans, or allocation outcomes for any product. Most products carried by Sole Play are limited releases and are not restocked. Allocation of limited or high-demand product is conducted exclusively through raffle systems or first-come, first-served in-store releases. Sole Play reserves the absolute right to determine allocation methods, decline any sale, void raffle entries suspected of automated entry or fraud, and cancel any order at our sole discretion.
3. Orders and Payment
When you place an order, you are making an offer to purchase. We accept: Visa, Mastercard, American Express, Discover, PayPal, Apple Pay, Google Pay, Shop Pay, and Shop Pay Installments. You represent that you are authorized to use the payment method provided. Sole Play reserves the right to refuse or cancel any order for any reason at our sole discretion.

6. Accounts

THE SITE AND ALL PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
11. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, SOLE PLAY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. Our total aggregate liability shall not exceed the amount you paid for the specific product or transaction giving rise to the claim. 12. Indemnification
You agree to indemnify and hold harmless Sole Play and Favorite-Hi-Fashions, Inc. from any claims arising out of your use of the Site, your violation of these Terms, or your violation of any third-party right.
13. Governing Law
These Terms are governed by the laws of the State of Alabama, without regard to its conflict-of-law principles. Disputes shall be subject to the exclusive jurisdiction of state and federal courts in Houston County, Alabama.
14. Severability
If any provision is found unenforceable, it shall be severed without affecting the remaining provisions.
15. Entire Agreement
These Terms, together with our Privacy Policy, Shipping Policy, Refund Policy, and Legal Notice, constitute the entire agreement between you and Sole Play.
16. Pricing Variance Between In-Store and Online
Sole Play operates a physical retail location at 102 Central Park Avenue, Suite 1, Dothan, AL 36303 and an online store at soleplaybama.com. Product pricing, promotions, discounts, and availability may vary between our Dothan, AL retail location and our online store.
A price displayed at one channel does not guarantee the same price at the other. Pricing differences may reflect local promotional events, inventory levels, supplier costs, and operational factors unique to each channel. Sole Play reserves the right to set and adjust pricing independently for each channel at its sole discretion, without prior notice.
Customers are not entitled to price matching between in-store and online prices unless a specific, written price-match offer is made by Sole Play at the point of sale. In-store pricing is valid only at our retail location. Online pricing is valid only for purchases completed through soleplaybama.com.
We make every effort to ensure pricing accuracy; however, errors may occur. Sole Play reserves the right to correct pricing errors and cancel any orders placed at an incorrect price.
17. Changes to These Terms
We may update these Terms at any time. Changes are effective immediately upon posting.
